How it works

  1. List what exists

    Bank accounts, mutual funds, insurance, property, jewellery, the small forgotten account nobody remembers. An asset nobody knows about is the one that causes trouble later.

  2. Reconcile nominations with intentions

    Every nomination is checked against what you actually want to happen. This is where most of the surprises are found, and where most of the value in the exercise sits.

  3. Get it drafted and executed properly

The nomination misunderstanding

Nominations and wills serve different purposes. Their effect depends on the asset and applicable law, and some life insurance nominations can confer beneficial entitlement. Do not assume that every nominee is only a trustee or that a will always takes priority.

Common questions

Is a nomination the same as a will?

No. The effect of a nomination depends on the asset and applicable law. Some life insurance nominations can confer beneficial entitlement. Review nominations and your will together with a qualified legal professional rather than assuming one overrides the other.

Does a will have to be registered?

Registration is not mandatory for a will to be valid in India, though it can make it harder to challenge. Proper execution and witnessing matter more than registration, which is why the drafting should be done by someone who does it regularly.

I do not own much. Do I still need one?

The size of the estate is not really the point. The purpose is to remove ambiguity at the worst possible time for the people you leave behind. Small estates produce family disputes just as readily as large ones.
